Another Kenyan MP loses seat

Mr. Hassan becomes the sixth Member of Parliament in the 10th parliament to lose his seat in a string of election petitions filed against sitting MPs over election irregularities.

Justice Luka Kimaru sitting in Milimani Court in Nairobi cleared Hassan of any election irregularities but ruled that the flaws that were occasioned by the defunct Electoral Commission of Kenya officials amounted to serious breaches of the National Assembly and Presidential Act rules.

Kimaru ruled that the officials transferred two polling stations only twenty four hours before the election on 27 December 2007 therefore confusing voters.

Justice Kimaru also criticized the officials for allowing voting to go on until midnight violating the time that is allowed by the law. 

The judge said that the officers failed to guide the over 90% illiterate voters in Wajir south to exercise their free will in the election. 

Hassan had vied for the seat on a KANU ticket.

The petition was filed by Mohamud Sirat who had vied on an Orange Democratic Movement- Kenya(ODM-K) ticket.

The other legislators who have so far lost their seats are Joel Onyancha (Bomachoge), Omingo Magara (South Mugirango), George Thuo (Juja), Dick Wathika (Makadara) and Chirau Ali Mwakwere (Matuga).

Last week, Mr Mwakwere has managed to recapture his seat.

However, by-elections for Juja and Makadara constituency are yet to be held.

Eyes are now on Starehe Constituency in Nairobi where former sports ministers Maina Kamanda is locking horns with bishop Margaret Wanjiru.

The judgment on the petition is expected on July 30.
