Europe Looks Into Possible War Crimes in Somalia

NAIROBI, Kenya, April 5 — European diplomats said Thursday that they were investigating whether Ethiopian and Somali government forces committed war crimes last week during heavy fighting in Somalia’s capital that killed more than 300 civilians.

The fighting, some of the bloodiest in Somalia in the past 15 years, pitted Ethiopian and Somali forces against bands of insurgents and reduced blocks of buildings in Mogadishu, the capital, to smoldering rubble. Many Mogadishu residents have complained to human rights groups, saying that the government used excessive force and indiscriminately shelled their neighborhoods.

On Thursday, Eric Van der Linden, chief of the European Commission’s delegation to Kenya, said that he had appointed a team to look into several war crime allegations stemming from the civilian casualties. “These are hefty accusations,” Mr. Van der Linden said. “We are examining them very prudently.”

In an e-mail to Mr. Van der Linden marked “urgent,” a security adviser to the commission wrote that there are “strong grounds” to believe that Ethiopian and Somali troops had intentionally attacked civilian areas and that Ugandan peacekeepers, who arrived in the country last month, were complicit for standing by. The e-mail was provided by someone who thought that the issue should become public and its authenticity was confirmed by commission officials.

Ethiopian, Somali and Ugandan officials denied Thursday that their soldiers had done anything wrong.

A war crimes case is about the last thing Somalia’s transitional government needs. Ever since it took control of Mogadishu in late December, the transitional government has struggled to pacify the city and win popular support.

Many Western diplomats had expressed hope that this transitional government, Somalia’s 14th, would end the seemingly interminable chaos that has enveloped the country since the central government collapsed in 1991. But so far, the government has failed to deliver the same level of stability that an Islamist administration brought during its brief reign last year. It was overthrown by Ethiopian-led forces, with covert American help.

Mogadishu has become so dangerous — again — that many residents say they are now doubting whether the government will be able to hold a major reconciliation conference scheduled for mid-April. The Ethiopian military struck a truce with insurgents on Sunday, though, and the past three days have been quiet, giving beleaguered residents a chance to bury their dead.

The European Commission has no authority to prosecute war crimes and would have to refer any findings to the International Criminal Court. But commission officials said they were investigating the accusations because the commission has provided money and technical assistance to the transitional government and the peacekeeping mission here there.

A Western official who spoke on the condition of anonymity because of diplomatic considerations predicted that even if there were compelling evidence of war crimes, the case would probably never get to court.

Another Western official, speaking anonymously for similar reasons, said, “At the end of the day, no one is going to want to further undermine the transitional government.”

Diplomats, and analysts from Somali and international organizations predicted Thursday that the American government would resist the European effort because Ethiopia is a close American ally, valued as bulwark against Islamic militants in the Horn of Africa.

In the past week, human rights groups have been urging someone to look into the civilian casualties issue. The Somali Diaspora Network, an American-based advocacy group, accused the transitional government and Ethiopian forces of “collective punishment” and genocide.

The Somali Disapora Network said that Abdullahi Yusuf Ahmed, the transitional president, warned in a recent radio interview that “any place from which a bullet is fired we will bombard it regardless of whoever is there.”

Several of the analysts said that they believed Ethiopian forces overreacted in last week’s fighting. One analyst who works closely with Somali issues said Ethiopian soldiers may have panicked after they were surrounded by insurgents in Mogadishu’s main stadium and commanders responded by carpet-bombing the entire neighborhood.

Ethiopian officials denied this.

“Our forces have been praised for not attacking civilians and nothing in recent days has changed,” said Zemedkun Tekle, spokesman for the Ethiopian government.

Abdirizak Adam Hassan, chief of staff for Somalia’s transitional president, did not deny that many civilians had been killed. “Unfortunately, this is what happens when you fight in a city,” he said.

But, he said, the government was simply trying to defend itself.

“For a good two months, these insurgents have been attacking our government compounds, planting land mines in the road, assassinating people,” he said. “Our job is to protect the people, not kill them.”

 As mentioned in this report the Americans will not allow war crime allegation to be refered to Internatonal criminal court. The Americans and international commuty were too eager to prosecute top Sudanese official for apparent crimes commited by a third party(the Janjaweeds) but will not allow investigation of a genuine war crime commited in Mogadisho.But I urge the Somali people not to lose hope and must gather all the evidence they can and present them to human rights organization. The Somalis living in Europe and America must lead the way in making sure justice is attained for the hundreds of innocent killed. Abdullahi Yusuf and his Ethoipians master must not get away with this crime.

 Attention guys, who heard that Mr. A/llahi Yey paid an unannounced visit to the Somali-kenyan border to talk to the somali refugees in the kenyan side, especially those who have been there for years (the Darod ones). he pledged them to evacuate these camps for the newly arriving Mogadishu mooryaans. he predicted many more r on their ways. when asked how come they havent reached here yet since the war in mogadishu has beeng going on for weeks, and it took us, we Darod refuuges, few days to get here, he replied with laughter and said "adeerayaal ninmanku dameeray ku soo guureen idinkuna baabuur, marka alaabtiina kasii aruursada hana sugiwaayinina

 This is a good news we need to bring to light the darkness
and devilish act that Abdullahi Yusuf and his stooges have
committed they have committed an act of genocide the world
knows and heard what took place the indiscriminate killing
where Abdullahi Yusuf's supports and Ethiopia's Army used
artillery shelling where Ethiopia Army used helicopter
gunships, multiple launch rocket system BM, Tanks and other
modern weapons against defenseless civilians disregarding
the rule of international laws, it is the responsibility
of the international community, United Nation / International
Criminal Court and other international entities to prosecute
These war criminals Abdullahi Yusuf & his supports
Ethiopia Army & its Officials which they have done a crime
against humanity, justice will be served, the article above

If this is the case then we’re not living in
a civilized world it is jungle out there and it is

 HISTORY IS REPEATING ITSELF AS WE SAID MANY TIMES BEFORE:
The United States have supported Sadam Hussein during his war with Iran & the atrocities he committed against his people Shiites & Kurds.
They supplied him with most of the chemicals he used against his people as well as the Iranians.
Ironically, It was Donald Rumsfeld who was President Reagan's envoy to Iraq during the Iran-Iraq war.
Then it was Rumsfeld who as a defense minister during the invasion of Iraq in May, 2003. He told the world time & time again that Sadam Hussein was a criminal on the basis of human rights abuses.
He was charged with killing thousands of unarmed civilians to stay in power... which is genocide.
Please compare the facts I presented above with the current relationship between Zenawe & USA. Will you be surprised if they charge him with genocide?
The Somali stooges, so-called TFG is just a tool being used by Zenawi & will be dealt with as such.

 Well, everything has a payback. The war will not stop in Mogadishu.
The traitors will be followed back to Puntland and in the process
of liberating Puntland from Ethiopian traitors, there will
be collateral damage and loss of human life in Puntland.

Afbiijo & his supporters will get a taste of what Afbiijo has done
in Xamar. I am sure there will be a major outcry among some here
when the liberation of Puntland from Ethiopia takes place.
The same characters screaming "Dowladdiid" and "Mooryaan" will be
preaching human rights to us.

 Bush Administration can NOT stand in the way  for this investigation to continue and bear some fruits that will not make happy some of the commentators in this site.  Why Bush Admin. has no chance?  Because EU needs no UN resolution to file a case against the top leadership of TFG and Ethiopian Commanders.

EU has ignored many alarm bells that warned them not to fund this warlord-ridden TFG government.  I think if they are serious about this investigation they can, possibly, regain their name and clout to counter the Bush Administration's ill-advised, hawkish policies toward Horn of Africa Region.

I must also commend the Somali Diaspora Network and Somali journalists for the little things they have done so far in bringing these crimes to light.  Keep up the good work!!

 I think there is plenty of evidence that the Ethiopian occupation forces nad their stooges have committed war crime and crime against humanity. Abdulahi Yusuf himself said that they will bomb the civilian areas if one bullet is fired from their neighbourhood. We are now documenting all the atrocities committed in Somalia so that all those who be aresponsible be brought before a court of law. Abdullahi Yusuf and other warlords in his government and Ethiopian generals who ordered this carnage should be punished for their horrendous crimes.

EU is simply playing the plame game, they loosing influence on TFG to USA
